Intellectual Property

We understand Intellectual Property in a general context that includes Industrial Property and Intellectual Property (in its strict sense); in this sense we are involved in each of the rights that comprise them, that is: Trademarks, Patents, Technology, Industrial Designs, Utility Models, Plant Varieties, Industrial Secrets, Know How, Privileged and Confidential Information, Domain Names, Copyrights and Related Rights, Reservations of Rights and we include advice on the new subject of Personal Data.

We have divided the area of Intellectual Property into 4 parts:

  1. Procedure. Our area includes: the constitution, maintenance and renewal of rights, in which we carry out a review from a legal point of view and not just a procedural one, so that each opinion, search and consultation includes a strategic and economically convenient position for our clients, not only in Mexico but internationally, through our network;
  2. Litigation. intellectual property, including administrative proceedings at all levels up to protection and review, as well as commercial litigation that today allows for the immediate collection of damages in copyright matters.
  3. Transactional. in which we incorporate:
    • Our knowledge and experience in audits (due diligence) and M&A's;
    • Advice on contracts “of” or “related to” intellectual property, eg: employment contracts (which should include clauses that protect the intellectual property of companies from their employees) or service contracts with advertising agencies that assist in the creation of new products, brands, designs or advertising campaigns and which may generate ownership issues if not properly documented);
    • Strategies for the protection of Intellectual Property, using a global vision of all intellectual property rights (expanding protection in trademark or copyright matters and even inventions when appropriate) understanding each business, considering the importance of a project and budget limits.
  4. Personal Data. Since 2010, and due to the proximity of the subject of Personal Data with the right to image, right of publicity, and the obligations on data in the laws that protect consumers, we took on the challenge of including this subject as part of Intellectual Property and the services we offer (see our comments in a separate document).
