Since 2010, there has been a general obligation to protect the personal data of individuals, through specific actions such as:

  1. Obtaining the consent of the owner (tacit, express or in writing, depending on the analysis of the case)
  2. Preparation and notification of the Privacy Notice, in accordance with the guidelines;
  3. Data transfer in accordance with current legislation (one of the most controversial points in this matter);
  4. Adoption of protection and security measures (physical, administrative and technical);
  5. Determination of those responsible and in charge for each case of management or treatment;
  6. Appointment of a personal data manager or department.

Intellectual and industrial property

Review your employment contracts

In various audits, we have noted the lack of clauses regulating intellectual property issues. As in any human relationship, in labor relations works, inventions, new developments, and information can be created that generate competitive advantages for the employer. All of this can be subject to protection in terms of intellectual property.
